The hearing decision was overturned by a decision of the Court of Queen’s Bench (now King’s Bench) and restored on appeal to the Court of Appeal. The Court of Appeal allowed the appeal from the penalty decision and ordered a new penalty hearing. Council’s penalty and costs order included a four year suspension already served and payment of 50% of the costs in the amount of $48,288.55 payable within 5 years of Dr. Leontowicz obtaining a licence to practice medicine.
